This includes assisting the associations in collecting delinquent payment of assessments and fines, and interpretation of governing documents, bylaws and Florida Statutes. Often, when a unit owner (condominium) or a homeowner (HOA) are not current in their payments, Florida Law allows the associations to serve a demand letter followed by a lien against the real property to enforce the collection. In many cases, this will result in payment. However, if it does not, in many cases the associations have the right to sue the delinquent party to foreclose that lien against the real property owned by the delinquent unit / home owner. Please be advised however, that lien foreclosure laws are highly technical and strictly enforced. Therefore, it is advisable to consult with an attorney.

Further, aspects of a lien foreclosure / collection lawsuit, including aspects such as the interest, late fees, and attorney’s fees the associations may be entitled to receive may be controlled by the wording of the governing documents of your community. It may be possible to change these documents to better protect the needs of your association. Maier Law, P.
